Founding Partner Saad Al Doseri and Senior Associate Shooq Mohamed were recently invited by the Judicial and Legal Studies Institute to present a lecture on Bahraini legislation on 13 December 2023. Their lecture, which focussed on arbitration agreements, formed part of the JLSI’s training programme for new lawyers.
During the lecture, Saad and Shooq offered valuable insight into the considerations which must be taken into account when drafting arbitration agreements, and the associated challenges. Their presentation went beyond theoretical discourse, drawing from personal experience to guide and facilitate discussions and provide a practical perspective on navigating arbitration cases and mitigating potential disputes arising from the interpretation of defective arbitration clauses.
Using his own experience as an arbitrator, Saad discussed the manner in which courts may deal with defective arbitration clauses. He further explained how an understanding of governing law and jurisdiction is important when effectively handling an arbitration, and why these factors must be taken into consideration. Saad also explored common matters in which arbitration is neither appropriate nor authorised under the laws of Bahrain, and where an arbitration clause is, thus, not permitted.
As part of the comprehensive training session, the participants were guided through practical exercises which offered a hands-on experience in reviewing and analysing defective arbitration clauses.
