On 25 November 2025, Prominent Bahraini lawyer and founding partner of Al Doseri Law, Saad Al Doseri, participated as a panellist in a high-level session titled “Legal 101 & Due Diligence: What Must Every Property Investor Know?” at Cityscape Bahrain 2025, one of the region’s premier real estate gatherings.
Addressing an audience of investors, developers, and sector professionals, Saad delivered clear and practical guidance on the critical legal foundations required for safe and informed real estate investment. He emphasised that real estate decisions are fundamentally legal risk-management choices, not merely financial ones.
Legal Due Diligence as the First Line of Protection
Saad pointed out that most real estate disputes arise from insufficient early investigation. “An hour of due diligence can save years of litigation,” he said, stressing the need for thorough legal checks to avoid ownership conflicts, hidden liabilities, and inaccurate representations.
Ensuring Clear Title and Verified Ownership
He explained that the first step in any acquisition is verifying that the property title is clear, unencumbered, and legally transferable. He cautioned investors against relying solely on marketing materials and advised them to base decisions on verifiable records and independent legal review.
Regulatory Compliance and Developer Transparency
Saad highlighted the importance of confirming regulatory compliance from the outset, including project approvals, construction milestones, escrow protections, and the legal standing of registered developers under bodies such as RERA. “Compliance is not a formality — it is your first layer of protection,” he noted.
Contracts: Where Investors Win or Lose
Saad stressed that contracts are often the most overlooked yet most critical component of any investment. He highlighted essential clauses investors should focus on, including payment schedules, handover obligations, penalties, termination rights, and warranties. “A contract exists to protect you when things do not go as planned,” he said.
Navigating Off-Plan Investment Risks
With off-plan developments rising in popularity, Saad provided a practical due diligence framework: Approvals → Escrow → Timeline → Warranties → Contract clarity. He advised investors to beware of unrealistic payment plans and to ensure all documentation aligns with Bahraini regulatory standards.
Post-Handover Legal Responsibilities
Saad concluded by outlining key post-handover considerations such as service charges, community management, structural warranties, and landlord–tenant obligations for investors intending to lease their properties.
